| Emergency Planning and Community Right-To-Know (EPCRA) and ARS TITLE 26, Chapter 2, Ariticle 3 "FACILITY REPORTING". |

| Your company and/or any of its sites may be subject to the reporting requirements of the Superfund Amendments and Reauthorization Act (SARA) of 1986. Under these requirements a a company and/or any of its sites are required to submit a Tier II Emergency and Hazardous Chemical Inventory report for each site owned/operated that meets either one or both of these conditions. |

Stores, produces or uses any of the extremely hazardous substances that appear in the EPA Title III List of Lists publication in quantities equal to or greater than the listed Threshold Planning Quantity (TPQ) or 500 lbs., whichever is lower (a copy of this publication can be obrained either from your Local Emergency Planning committee, the EPA Hotline or by clicking on the internet link below. |

Stores, produces or uses any other chemicals in amounts equal to or greater than 10,000 pounds and for which you are required to prepare or have available a Matieral Safety Data sheet in accordance with the OSHA Hazard Communications Standard. |

If your company and/or any of its sites: |

Meets one or both of the above reporting requirements a separate Tier II Emergency and Hazardous Chemical Inventory Report must be filled out for each site that is required to reprot and a copy of the report must be sent to the appropriate agencies. This report is due annually by March 1, and covers the reproting period of January 1 to December 31 of the previous year. |

Does not meet either of the above requirements (see Tier Two instructions for reporting thresholds and exemptions), then an exemption letter (see below for the internet link to an "Exemption Letter" form that can be used stating the reason that the company and/or site is not required to report needs to be sent to the appropriate agencies. |

| If your company and/or any of its sites are rquired to submit a Tier II Emergency and Hazardous Chemical Inventory Report, you may file the report electronically at the follwoing Internet address: http://www.azserc.org. If you opt to file electronically, you are still required to submit a hard copy to the Pima County Local Emergency Planning Comittee. If you opt to file electronically, contact your local fire department or fire district to determine if they require a hard copy. |

| If your company and/or any off sites are located on an Indian Reservation, you will need to file a copy of either the Tier II Emergency and Hazardous Chemical Inentory Report or an exemption letter with the appropriate Tribal Emergency Response Commission (see below for Internet link to the Tribal Emergency Response Commission Contact List). |

| Also, under the Arizona Revised Statutes, Title 26, Chapter 2, Article 3, each facility or site with extremely hazardous substances in qualities at or above the Threshold Planning Quantity is required to submit a Facility Emergency Repsonse Plan. |
